Constitution

Article I - Name and Purpose

Section A. Name

This organization shall be known as the Virginia Tech Amateur Radio Association.

Section B. Purposes

The purposes of this organization shall be to encourage an understanding of and an interest in amateur radio; to provide equipment for use by students, faculty, and staff interested in amateur radio; and to provide emergency and/or public service communications when needed.

Section C. Affiliation

This organization shall be affiliated with the American Radio Relay League. This organization shall also be registered as a student organization at Virginia Tech.

Article II - Membership

Section A. Membership Categories

* Full Membership: Full members are voting members. Full membership in this organization shall be open to all dues paying students, faculty, and staff who have a genuine interest in amateur radio and an amateur radio license valid in the United States.  Full members shall have open access to the organization's equipment.

*Associate Membership: Associate membership is available to anyone who is not currently a Virginia Tech student, faculty, or staff member, but has a genuine interest in amateur radio, has an amateur radio license valid in the United States, is approved to become an associate member by the voting membership, and pays dues.  Associate members have open access to the organization's equipment, but do not receive after-hours Squires access.

To become an Associate Member, a candidate must first be sponsored by a Full Member in good standing.  The sponsor will make the case for the candidate at a regular club meeting.  A majority vote of voting members at the meeting will approve the membership. Membership must be reviewed and re-voted on annually.

* Non-voting membership in this organization shall be open to all alumni, faculty, and staff of Virginia Tech and all other persons who have a genuine interest in amateur radio. A valid amateur radio license is not a requirement for non-voting membership.  Non-voting members do not have to pay dues to this organization.  Non-voting members will not be given the shack door code, equipment borrowing privileges, or after hours access to Squires Student Center.

* Individuals may be elected to honorary lifetime membership by nomination of the executive committee and election by the voting membership. They shall be included in all regular mailings to the organization's membership.

Section B. Non-discrimination Statement

No individual shall be excluded from membership in this organization on the basis of race, sex, handicap, age, veteran status, national origin, religion, political affiliations or sexual orientation.

Article III - Dues

Every voting member of this organization shall be assessed dues at a rate set by the Executive Committee and approved by the voting membership at the second meeting of fall semester.

Article IV - Governance

Section A. Officers and Elections

The officers of this organization shall be: President, Vice President, Secretary, Treasurer, and Maintenance Officer. The officers shall be elected by a majority vote of the membership at the last meeting before Spring Break of each year, with the exception of the Maintenance Officer, who shall be selected by the Executive Committee at its first meeting.

Section B. Terms of Office and Reelection

Officers shall serve for one year beginning with the date of their election. No officer may serve more than two terms in any single office.

Section C. Qualifications

* The President and Vice President must have a valid amateur radio license at the time of their election and for the duration of their term of office.
* The president must be enrolled as an undergraduate student at Virginia Tech.
* The President may not serve in any other elected position.
* The Vice-President may not serve in any other elected position.
* The Secretary may concurrently serve as the elected Treasurer.
* The Treasurer may concurrently serve as the elected Secretary.
* The Equipment Officer position may be filled by any voting member, regardless of any other positions that person may hold.

Section D. Impeachment

* Any officer may be removed from his or her position by 3/4 vote of the voting membership provided that written notice has been given each member two weeks in advance of the meeting at which the impeachment vote is to take place.
* Any person removed from office by impeachment may not be elected or appointed to any office for one year following his or her removal.

Section E. Duties of the President

* The President shall preside at all meetings of both the organization and the Executive Committee. The President shall also decide all questions of order.
* The President shall be familiar with and enforce both the constitution and bylaws of the organization.
* The President shall be the official representative of the organization and sign all documents of the organization.
* The President shall vote at meetings only in case of a tie.
* The President shall be responsible for maintaining insurance for all of the organization's major equipment.
* The President shall be responsible for maintaining affiliation with the American Radio Relay League by filing an annual report with that organization.

Section F. Duties of the Vice President

* In the absence of the President, the Vice President shall act in the official capacity of the President and assume all duties of that office.
* The Vice President shall be responsible for arranging programs for the organization's meetings if so desired by the membership.
* The Vice President shall perform such other duties as delegated by the President or the Executive Committee.

Section G. Duties of the Secretary

* The Secretary shall take and keep minutes of all meetings of the organization and of the Executive Committee.
* The Secretary shall maintain an accurate roll of the organization's membership.
* The Secretary shall issue all necessary notices concerning both regular and special meetings such that members have at least 36 hours advance notice.
* The Secretary shall perform such other duties as delegated by the President or the Executive Committee.

Section H. Duties of the Treasurer

* The Treasurer shall establish and maintain financial records of the organization in accordance with the Uniform Accounting System of Virginia Tech.
* The Treasurer shall be responsible for preparing and presenting the annual budget to the Student Budget Board of Virginia Tech.
* The Treasurer shall render a report of the organization's finances at regular meetings of the organization or at the request of the Executive Committee.
* The Treasurer shall be held responsible and accountable to the organization for all financial transactions.
* The Treasurer shall collect all dues.
* The Treasurer shall perform such other duties as delegated by the President or the Executive Committee.

Section I. Duties of the Maintenance Officer

* The Maintenance Officer shall be responsible for ensuring that all of the organization's equipment is in good working order.
* The Maintenance Officer shall have the authority to shut down any piece of organization equipment for maintenance or safety reasons and must promptly report any such action to the Executive Committee.
* The Maintenance Officer shall ensure that members are familiar with the proper operating procedures of all organization equipment that they wish to operate.
* The Maintenance Officer shall perform such other duties as delegated by the President or the Executive Committee.

Section J. Advisor

The organization shall have an advisor from the faculty or staff at Virginia Tech whenever possible.

Section K. Executive Committee

* The business of the Executive Committee shall be administered by the Executive Committee. The membership of the Executive Committee shall be: President, Vice President, Secretary, Treasurer, and Maintenance Officer.
* The Executive Committee shall meet regularly at a time and place specified by the President.
* The Executive Committee shall consider the agenda in advance of the next business meeting.
* The Executive Committee shall have the power to act on the organization's behalf at any time such action is necessary. They shall be responsible to the membership for all action taken and may not modify any action taken by the membership as a whole.
* Each individual on the executive committee shall have one vote, regardless of the number of positions that individual holds.

Section L. Committees

The organization may establish standing or special committees to support the activities of the organization.

Article V - Meetings

Section A. Meetings

Regular meetings of the organization shall be held no less than twice each month during fall and spring semesters at a time approved by the membership. Special meetings may be called by the President upon approval of the Executive Committee.

Section B. Quorum

For the purposes of conducting regular organization business, a quorum shall be defined as the members present at any meeting for which established notification procedures were called.

Section C. Rules of Order

Robert's Rules of Order shall govern the organization in all cases where they are applicable unless superseded by the constitution or bylaws of the organization.

Article VI - University Policies

This organization shall abide by all policies contained in the University Policies for Student Life of Virginia Tech.

Article VII - Bylaws

This Organization shall adopt a set of bylaws for the specific regulation of its business. The bylaws may be amended by a 2/3 majority of the voting membership of the organization.

Article VII - Amendments

* This constitution may be amended by a 2/3 majority vote of the voting membership.
* Proposed amendment(s) must be submitted in writing to the Executive Committee and may not be voted upon until a date set by the Executive Committee. In addition, written notice of the substance of the proposed amendment(s) must be sent to each member at least two weeks before the meeting at which the voting is to take place.

Article IX - Adoption

This constitution shall take effect with a 2/3 majority vote of the voting membership.
